Openings in Anime are not always scenes from the episodes. He just appeared in the Opening to look cool. There was also one of the Hell: Lust demons which also did not make an appearance.

phantom was one of my favourite bosses. not because he was difficult cos he wasnt i just thought he looked cool. i wish they had put him in. i mean they could have as its set before dmc2 and for some weird reason phantom makes an appearance there

Phantom was quite the boss. Awesome presentation, looks cool, and a fun fight. The only one that comes close to him is Cerberus imo. its a shame the anime went no where story wise...
